0. Introduction

0.0. The ecommerce website albogroupitaly.com is owned by ALBOGROUP SRL, headquartered in Lallio (BG) at via Arti e Mestieri, 7, with VAT number 00693960163.

0.1. Following an agreement with the company holding the trademarks present on the albogroupitaly.com website, the ecommerce site albogroupitaly.com is managed until a new agreement between the parties by the company Concept Trends & Shots snc, with legal and operational headquarters in Cornate d’Adda (MB) at via Primo Maggio 30, and with VAT number 03037120163.

0.2. The sale and invoicing of orders from the albogroupitaly.com ecommerce site are carried out by the company Concept Trends & Shots snc, which also manages Customer Service until new agreements with the trademark holding company are made.

1. Subject

1.1. These General Terms and Conditions of Sale (hereinafter, General Terms) govern the purchase of Products made remotely via the internet from the website albogroupitaly.com (hereinafter, the Website).

1.2. The owner of the Website is Albogroup S.R.L., via Arti e Mestieri, 7 – 24040 Lallio (BG), Italy, and the operator is Concept Trends & Shots snc, via Primo Maggio, 30 – 20872 Cornate d’Adda (MB), Italy.

2. Acceptance of the General Terms and Conditions of Sale

2.1. All purchases of Products made through the Website (hereinafter, Purchase Contracts) by users accessing it (hereinafter, Customers) are governed by these General Terms and Conditions as well as by the Italian Consumer Code (Legislative Decree No. 206/2005), Section II Distance Contracts (Articles 50 – 67), and the Italian regulations on electronic commerce (Legislative Decree 70/2003).

2.2. By concluding the Purchase Contracts, according to the procedure, the Customer accepts and agrees to comply with these General Terms and Conditions.

2.3. Therefore, the Customer is required to carefully read these General Terms and Conditions before making any purchase operation, which Concept Trends & Shots snc makes available to them also to allow their reproduction and storage in compliance with the provisions of Article 12, 3rd paragraph of Legislative Decree 70/2003.

2.4. Concept Trends & Shots snc may change, at any time and without notice, the content of the General Terms and Conditions. Each Purchase Contract will apply the General Terms and Conditions published on the Website at the time the Customer sends the purchase order.

3. Products

3.1. albogroupitaly.com (hereinafter “Website”) is an online sales site for cosmetics, beauty products for body care, makeup, and related accessories (hereinafter “Products”).

3.2. All the Products offered are illustrated in detail on the Website, within their respective sections, categorized by Product type.

3.3. The visual representation of the Products on the Website, where available, is indicative and usually corresponds to the photographic image of the Products themselves and is intended solely to present them for sale, without any guarantee or commitment by Concept Trends & Shots snc regarding the exact correspondence of the image depicted on the Website with the actual Product, particularly with respect to its actual dimensions and/or the chromatic aspects of the Products and/or their packaging.

3.4. In case of a discrepancy between the image and the written product description, the product description shall always prevail.

4. Purchase Procedure

4.1. The Customer can purchase the Products on the Website, which are illustrated in detail within their respective sections by Product category, as described in the relevant information sheets on the Website, following the technical access procedures specified therein.

4.2. To purchase the Products, the Customer must register on the Website by entering their personal details, following the instructions provided by the registration program, and must complete and send to Concept Trends & Shots snc the electronic order form available on the Website, following the instructions provided therein. Purchase orders must be fully and accurately completed. If the Customer does not wish to register on the Website, they can still complete the purchase procedure but will not be able to check the status of their orders or take advantage of discounts and promotions.

4.3. The Customer must place the selected Products into the appropriate “Cart” and, after choosing the courier and viewing and accepting the delivery cost contribution, can proceed with the purchase.

4.4. If the Customer needs to modify the purchase order or change some of the data contained therein, they must follow the specific modification procedure on the Website. In particular, the Customer can modify the quantity of Products they intend to purchase, adding or removing one or more Products from the Cart.

4.5. Upon completion of this operation, the Customer will see a screen displaying a summary of the purchase order, including delivery costs, with a request for further confirmation to proceed with the purchase.

4.6. After viewing the summary, the Customer must select the desired payment method and send the order by clicking the appropriate button.

5. Conclusion of the Contract

5.1. The publication of Products displayed on the Website constitutes an invitation to the Customer to submit a contractual purchase proposal. The order sent by the Customer is considered a contractual proposal and entails complete knowledge and full acceptance of these General Terms and Conditions.

5.2. Each Purchase Contract concluded between Concept Trends & Shots snc and the Customer shall be deemed concluded when Concept Trends & Shots snc sends an acceptance of the order to the Customer’s email address. This confirmation message will include an “Order Number,” to be used in any further communication with Concept Trends & Shots snc. The message will reiterate, in addition to the legally required information, all the data entered by the Customer, who undertakes to verify their correctness and promptly communicate any corrections. Any additional costs arising from errors in the data not promptly reported will be the sole responsibility of the Customer.

5.3. Each order can be viewed by the Customer on the Website, in their personal area, if registered, immediately after sending the order.

5.4. The indication regarding the availability of Products is not binding, except for Products marked as “not available,” which cannot be ordered by Customers. In case of subsequent unavailability of one or more Products indicated as available at the time the Order is sent by a Customer, Concept Trends & Shots snc, notwithstanding the provisions of art. 5.2, undertakes to promptly notify the Customer via email, proposing an alternative, if possible. In such cases, subject to the right of withdrawal under art. 10, the Customer can respond within 24 hours of receiving the email. If no response is received from the Customer within 24 hours, Concept Trends & Shots snc will proceed to dispatch the available Products. In case of payment by credit card or PayPal, Concept Trends & Shots snc will process the payment at the time of the Order, and any refund for unavailable Products will be promptly issued.

5.5. Concept Trends & Shots snc reserves the right, at its discretion, to accept or reject the order sent by the Customer, without the latter being able to make any claims or rights, in any capacity, including compensation, in case of non-acceptance of the order.

5.6. In particular, Concept Trends & Shots snc reserves the right to not accept purchase proposals and cancel orders that do not provide sufficient guarantees of solvency or in case of anomalies in transactions and payment methods used by the Customer, even after verification with the credit card payment management system.

5.7. The Customer can verify the content of the concluded purchase contracts at any time by accessing their personal area on the Website, if registered. These data will be available for a period of 12 months from the delivery of the Products.

6. Product Prices

The prices of the products are expressed in Euros and include VAT. The applicable price is the one indicated on the website at the time the Customer sends the order. Delivery costs are clearly highlighted at the time of the order. The cost of each shipment may vary depending on the delivery and payment method, as well as the destination and total order amount.

7. Invoicing and Payment Methods

7.1. Concept Trends & Shots snc issues a receipt for the Products purchased at the time the Products are delivered to the courier for shipment, sending it via email to the Customer or including the receipt in the package. The receipt will be based on the information provided by the Customer. No changes to the data will be possible after the receipt or fiscal receipt is issued. 7.2. Unless otherwise agreed, the Customer will pay the full price of the ordered items at the time of the Order submission. Concept Trends & Shots snc reserves the right to deliver the purchased items only after receiving full payment. During the order submission process, as specified on the Website, Concept Trends & Shots snc may offer different payment methods at its sole discretion, which may vary without prior notice, such as credit card payment, payment via the secure “PayPal” system, and payment with prepaid cards (e.g., “Postepay”). Upon confirmation of the Order, the amount corresponding to the Products purchased will be charged to the Customer.

Concept Trends & Shots snc reserves the right to change the payment methods available to Customers at any time, provided that the available methods are those published on the website at the time of the Customer’s order submission.

8. Delivery Methods and Costs

8.1. Concept Trends & Shots snc commits to delivering the goods without undue delay and in any case within thirty days from the conclusion of the contract. The delivery of the Products will be made by courier, and the times will vary depending on the destination. The terms indicated at the time of the purchase order are indicative.

8.2. Concept Trends & Shots snc delivers to all countries listed on the Website, and delivery will take place without an appointment.

8.3. No liability, in any capacity, may be attributed to Concept Trends & Shots snc by the Customer in case of delay in order processing or delivery of the Products subject to Purchase Contracts.

8.4. The ordered Products will be sent to the postal address specified by the Customer. Upon delivery of the Products by Concept Trends & Shots snc to the courier, a shipping confirmation email will be sent to the Customer.

8.5. Deliveries will be made from Monday to Friday during normal business hours, excluding national holidays, according to the methods indicated by the courier used. Delivery is deemed completed when the Product is made available to the Customer at the specified address on the order form. In case of non-delivery due to the recipient’s absence at the specified address, the courier will send an email notification and attempt a new delivery according to their predetermined methods. In case of impossibility to execute the new delivery due to the recipient’s absence, the Customer Service will try to contact the Customer to schedule a further delivery. For any reshipment of the product, the Customer will have to pay the shipping costs. If Customer Service is unable to contact the Customer for the next 10 days or in case of further impossibility to deliver due to the recipient’s absence, the Products subject to the order will be returned to Concept Trends & Shots snc. After 30 (thirty) days from the date on which the Products subject to the order were returned to Concept Trends & Shots snc due to delivery impossibility, the contract will be deemed terminated, and the purchase order canceled according to art. 1456 c.c. Concept Trends & Shots snc will proceed to refund the amount paid by the Customer, net of the costs of returning the Products and the storage costs at the courier’s branch responsible for delivery.

8.6. The contract termination and the refund amount will be communicated via email. The refund amount will be credited to the payment method used by the Customer for the purchase. If, before the expiration of thirty days, the Customer requests to receive the purchased Products again, Concept Trends & Shots snc will proceed with the new delivery after charging, in addition to the delivery costs, the costs of returning the Products to Concept Trends & Shots snc and the storage costs.

8.7. Upon delivery of the Products by the courier appointed by Concept Trends & Shots snc, the Customer is required to carefully check that the number of items delivered matches the number indicated on the transport document.

8.8. Any damage to the packaging/product of the Products must be immediately contested by Customers by writing a reservation for control on the proof of delivery from the courier. It is understood that once the document is signed by the courier without any contestation, Customers cannot raise any dispute with Concept Trends & Shots snc regarding the external characteristics of the delivered items.

8.9. Cases of force majeure, unavailability of transport means, or unforeseeable or unavoidable events that cause a delay in deliveries or make deliveries difficult or impossible, or that cause a significant increase in delivery costs charged to Concept Trends & Shots snc, will entitle the latter to split, postpone, or cancel, in whole or in part, the expected delivery or to terminate the Purchase Contract. In such cases, Concept Trends & Shots snc will promptly and adequately communicate its decisions to the email address provided by the Customer, who will be entitled to a refund of any amount already paid, excluding any further claims, in any capacity, against Concept Trends & Shots snc.

9. Discount Vouchers – Promotions

9.1. Any discount vouchers or promotional codes can be entered by the Customer when filling out the purchase order. The system will update the total order amount, net of the voucher value.

9.2. The discount voucher may be combined with other commercial initiatives only if explicitly indicated.

10. Right of Withdrawal and Its Effects

10.1. The Customer has the right to withdraw from the contract without indicating any reasons within 14 days.

10.2. The withdrawal period expires 14 days after the day the Customer or a third party, other than the carrier and designated by the Customer, acquires physical possession of the goods. In the case of a contract relating to multiple goods ordered in one order and delivered separately, from the day the Customer or a third party, other than the carrier and designated by the Customer, acquires physical possession of the last good.

10.3. To exercise the right of withdrawal, the Customer must inform Concept Trends & Shots snc of their decision to withdraw from the contract by email to ordini@albogroup.it or by registered mail with return receipt to Concept Trends & Shots snc, via Primo Maggio, 30 – 20872 Cornate d’Adda (MB).

10.4. To meet the withdrawal deadline, it is sufficient for the Customer to send the communication regarding the exercise of the right of withdrawal before the withdrawal period has expired.

10.5. If the Customer withdraws from this contract, all payments made to Concept Trends & Shots snc, including delivery costs (except for additional costs arising from the possible choice of a different type of delivery than the less expensive standard delivery offered), will be refunded without undue delay and in any event no later than 14 days from the day Concept Trends & Shots snc is informed of the decision to withdraw from this contract. Such refunds will be made using the same payment method used by the Customer for the initial transaction unless otherwise agreed; in any case, the Customer will not incur any fees as a result of such refund. The refund may be withheld until the goods are received or until the Customer has supplied evidence of having sent back the goods, whichever is earlier.

10.6. The Customer shall return the goods or hand them over to Concept Trends & Shots snc, via Primo Maggio, 30 – 20872 Cornate d’Adda (MB), without undue delay and in any event within 14 days from the day on which the Customer communicated their withdrawal from this contract. The deadline is met if the Customer sends back the goods before the period of 14 days has expired. The direct cost of returning the goods will be borne by the Customer. The Customer is only liable for any diminished value of the goods resulting from the handling of the goods other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Returns are accepted only for intact and still sealed products.

10.7. The Customer cannot exercise the right of withdrawal in case of sealed goods that are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.

11.0 Non-Conformity of Products and Defective Products

11.1. The Products offered on the Site comply with national and EU legislation. The images and colors of the Products published on the Site may differ from the actual ones due to local settings of the systems and/or tools used for their display.

11.2. In the event of non-conformity of the Products purchased with respect to the description published on the Site and in the case of faulty or defective Products, the Customer is entitled to an immediate refund of the non-conforming goods, upon sending photographs that highlight the damage or non-conformity of the Product via email to ordini@albogroup.it.

11.3. The staff of Concept Trends & Shots snc will follow up with communication indicating the refund method, which may also be, at the Customer’s discretion, in the form of discount vouchers for the next purchase, exceeding the value of the goods to be refunded, excluding any further liability of Concept Trends & Shots snc under any title.

11.4. In any case, the provisions regarding the legal warranty of conformity of goods, provided by the Italian Consumer Code (D.lgs. 206/2005, Part IV, Articles 102-135), remain unaffected.

12. Minors

Concept Trends & Shots snc does not sell products to minors. We sell products that can only be purchased by adults. If you are under 18 years old, you may use the site albogroupitaly.com only with the involvement of a parent or guardian.

13.0 Processing of Personal Data

Concept Trends & Shots snc declares and guarantees that the personal data of Customers will be processed in accordance with the provisions of Legislative Decree 196/03 and subsequent amendments and additions. Details regarding data processing methods are specified in the notice located in the section specifically dedicated, called “Privacy Policy.”

14.0 Communications and Complaints

All communications or any complaints from the Customer to Concept Trends & Shots snc regarding Purchase Contracts must be communicated through the appropriate tools available on the Site.

15.0 Intellectual Property Rights

All trademarks (registered and unregistered), as well as any and all works of the intellect, distinctive signs or denominations, images, photographs, written or graphic text, and more generally any other intangible assets protected by intellectual and industrial property laws and international conventions, reproduced on the Site remain the exclusive property of Albogroup S.R.L. and/or its licensors, without any rights being granted to the Customer through access to the Site and/or the stipulation of Purchase Contracts. Any use, even partial, of the same is prohibited without the prior written authorization of Concept Trends & Shots snc, to which all related rights are exclusively reserved.

16.0 Applicable Law and Jurisdiction

16.1 These General Conditions and any contract stipulated with the Customer are governed by Italian law, without prejudice to the application of EU regulations and international treaties, where applicable, as well as national consumer protection regulations.

16.2 The Customer accepts the exclusive jurisdiction of the Italian Courts. For any action arising from or related to the General Conditions of Sale, navigation, and use of the site, the Court of Bergamo shall have exclusive jurisdiction.

17.0 Prohibition of Resale

The products, services, and promotional samples on the Concept Trends & Shots snc site are for personal use only. Online consumers are not permitted to sell or resell the products, services, or promotional samples received. Concept Trends & Shots snc reserves the right to limit or terminate any supply of products or services if it has reason to believe that the user’s behavior may violate the Conditions of Sale.

18.0 Changes to the General Conditions of Sale

Concept Trends & Shots snc reserves the right to modify the site, policies, and these General Conditions at any time to offer new products or services or to comply with new legal requirements. The Customer will be subject to the General Conditions in effect at the time of the order, unless any changes are required by applicable law or by the Competent Authorities, in which case they will also apply to orders previously placed. Should any provision of these General Conditions be deemed invalid, void, or unenforceable for any reason, this condition will not affect the validity and effectiveness of the remaining provisions.
